Use and Restrictions

This site may be accessed and used only by individuals who can form legally binding contracts under applicable laws, who are 19 years of age or older, and who are not barred from using the sites under applicable laws.

Any unauthorized use of this site will terminate the permission or license granted by these Terms of Use, will result in you being barred from use of this site, and may violate applicable law including copyright laws, trademark laws (including trade dress), and communications regulations and statutes.

Terms of Sale

All product sales from the site are governed by any terms of sale that may be posted on the site. You should refer to our support page to learn more about applicable product warranties, our return policy, and shipping terms. By ordering and/or accepting delivery of the products, you agree to be bound by these terms of sale. The terms of sale are subject to change without prior notice at any time, in West Coast Gifts sole discretion so you should review the terms of sale each time you make a purchase. Our Products

Please note that our glass products are handmade. Please allow for variations in size and colour.

Stock and Availability

While we try to ensure that all the information on our website is accurate, unfortunately errors may sometimes occur. If an error has been made, we will inform you as soon as possible. We cannot guarantee availability on all items and reserve the right to cancel any order at any time.

If an item is out of stock at time of purchase, you will be notified so other arrangements can be made.

Pricing & Payments

All prices shown are wholesale prices. All prices are subject to change without notice. The (Manufacturer Suggested Retail Price (MSRP) shown on the site is calculated in Canadian Dollars and is a recommendation that the retailer sell the product.

Minimum Order

There is a minimum order of $200.00 on all orders after your first order.

C.O.D. Company Cheque

In order for us to accept your cheques you must have an approved credit application on file. Please call us to apply for C.O.D. Company Cheque payment terms.

Payment

When you make a purchase on West Coast Gifts website, you are agreeing that you are an authorized user of the credit card or debit card used to place your order. Payment will be processed at the time of purchase and an email will be sent to you confirming your order.

Credit Cards

We accept Visa and Mastercard. If you would like to pay by credit card, we must have a signed credit card authorization form on file. All credit card orders MUST be paid in full on the day we ship the order, otherwise there will be a 3% service charge on that order.

Late Payments

All pending orders will be held until payment is received.  Habitually late accounts will be changed to C.O.D. The Customer is responsible for any costs incurred by West Coast Gifts, Inc. in the collection of an account, such as agency fees, travel expenses, attorney fees or court costs. This includes finance charges of 1.5% per month (18% per year) on all past due balances.

Damages and Shortages: All damages and shortages must be reported within 48 hours. All merchandise leaves our warehouse in good condition. Should any packages be delivered to you opened, tampered with (re-taped) or in damaged condition you must notify the driver and have them make note to file a claim with the carrier at the time of delivery and notify West Coast Gifts within 48 hours.

You must KEEP ALL ORIGINAL BOXES AND PACKAGING for the shipping company inspection and to file a claim on shorted product. You must follow proper procedures. If we cannot file a claim, we will not be able to reimburse you for any loss or damage. We may also require digital pictures of any broken or damaged items.

Returned Cheques

Returned Cheques will result in terms being changed to C.O.D. Cash, Money Order, or Credit Card only. All pending orders will be held until balance is cleared. The customer will be charged $50.00, PLUS all bank fees.

Shipping

Most orders are shipped within 24 hours. Back orders are shipped at the customer’s request only. The customer is responsible for all freight charges, C.O.D. fees, insurance, and handling charges. Unless otherwise stated.

Refused Orders 

West Coast Gifts will fully credit or re-ship at our expense any orders refused due to the fault of West Coast Gifts. On all other refused orders the customer will be charged a 15% restocking fee plus all freight charges. If the customer wants the order re-shipped the additional freight charges will be added.

Returns

All returns MUST have a RETURN MERCHANDISE AUTHORIZATION (RMA) NUMBER. Unauthorized returns will not be accepted. Authorizations expire 30 days after date of issue. Speak to our West Coast Gifts Warranty & Returns Department to obtain an RMA Number. Please note that West Coast Gifts will not accept any item that has been used, except for vaporizers that are part of our in-house warranty program. All products must be returned in original unopened packaging. Please contact your sales representative to be notified of vaporizers that West Coast Gifts is able to warranty in-house, as some vaporizers may need to be sent directly back to the manufacturer.  All vaporizer returns sent to West Coast Gifts need to include a note detailing the reason for the return.  West Coast Gifts reserves the rights to destroy any vaporizer that is returned without being thoroughly cleaned.

Fraud

All orders are subject to various security checks. If our fraud detection system detects an anomaly with your payment, you will be contacted to confirm your details. We reserve the right to hold your order during this process while we await your confirmation. If we suspect fraud, we reserve the right to cancel your order and/or account and communicate your information to the relevant authorities. 

Price Match Guarantee

West Coast Gifts guarantees to have the lowest prices! We will meet or beat any advertised price for the exact same brand or product. If for some reason we can’t meet or beat the price, we will give you a coupon worth $25.00 off your next order. Limit four coupons worth $25.00 per store.  Call for full details.

Trademarks

All trademarks, service marks, trade names, logos and trade dress, whether registered or unregistered (collectively the “marks”) that appear on the sites are proprietary to West Coast Gifts or such Marks’ respective owners. You may not display or reproduce the marks other than with the prior written consent of West Coast Gifts, and you may not remove or otherwise modify any trademark notices from any Content. The Marks are protected by trademark, trade dress, copyright, and various other intellectual property rights and unfair competition laws.

In addition, all page headers, custom graphics, button icons, and scripts are trademarks, service marks, trade names and/or trade dress of West Coast Gifts or their respective owners, and may not be copied, imitated, or used, in whole or in part, without the prior written permission of West Coast Gifts.

West Coast Gifts is the EXCLUSIVE OWNER of the intellectual property rights associated with its trademarks Red Eye Glass®, GEAR® Premium, Retro Glass™, LIT™, LIT Glass™, Vapor Daddy™, Cheech & Chong™ Glass, Deluxe Daddy™, High Tek®, Goodfellas™, Red Eye Tek®, iRie™, Hoots™, and Bug Clip™.  Unauthorized use of West Coast Gifts trademarks is expressly prohibited. All rights reserved.

Exclusive Distributor of Trademarked Items:  West Coast Gifts is the EXCLUSIVE AUTHORIZED CANADIAN DISTRIBUTOR of products bearing its Red Eye Glass®, GEAR®, Retro Glass™, LIT™, LIT Glass™, Cheech & Chong™ Glass, Vapor Daddy™, Deluxe Daddy™, High Tek®, Goodfellas™, Red Eye Tek™, iRie™, Hoots™, and Bug Clip™ trademarks.  If any distributor, company or individual, other than West Coast Gifts, attempts to sell you product containing any of our trademarks listed above, they are ILLEGALLY selling you COUNTERFEIT merchandise that infringes on our intellectual property rights.  We kindly request that you immediately inform West Coast Gifts of any third party offering to sell you counterfeit products.  We intend to vigorously pursue legal action against any party infringing on our trademarks in order to protect you, our loyal customers, and our valuable trademarks.

The content, site, designs and images as well as the selection and arrangement thereof, are the sole property of West Coast Gifts and/or its licensors and are protected by patent, copyright, trademark and other intellectual property laws and may not be used except in accordance with these Terms of Use or with West Coast Gifts’ express written consent. Other than as necessary for your use of the site in accordance with these Terms of Use, West Coast Gifts grants no other privileges or rights in the content to you, and you must keep intact all patent, copyright, trademark and other proprietary notices on the content. Any content owned by West Coast Gifts’ licensors may be subject to additional restrictions. Except as expressly provided in these Terms of Use, no part of the site and no content may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted or distributed in any way to any other computer, server, web site, smart phone, tablet or other medium for publication or distribution or for any commercial enterprise, without West Coast Gifts’ express prior written consent.
